The deprivatization and dejudicialization of insolvency law (2021)

The author develops in this book a theory for a different articulation of bankruptcy law (“law of companies in difficulties”) consisting of its deprivatization and dejudicialization (progressive reduction of the role of the judge). After analyzing the meaning of bankruptcy institutions, she studies Spanish bankruptcy law, to examine refinancing agreements in the last chapter.
